Teacher Agreement

1. Introduction

This Teacher Agreement applies to all users who have access to teacher functionality on the Incapsulate platform.

This agreement forms part of the Incapsulate Terms and Conditions and should be read together with the Privacy Policy, Refund and Cancellation Policy, and any other applicable platform policies.

By activating or using teacher functionality, you agree to comply with this Teacher Agreement.

2. Teacher Responsibilities

Teachers are responsible for the administration and management of their classrooms on the platform.

Teachers agree to:

• Maintain accurate account information.
• Protect account credentials and class codes.
• Use the platform lawfully and responsibly.
• Manage student access appropriately.
• Create and manage assignments and assessments responsibly.
• Review student submissions before publishing marks where appropriate.
• Ensure uploaded educational content is appropriate and lawful.
• Ensure that students use the platform in accordance with applicable policies.

Teachers remain responsible for all activity occurring within classrooms under their control.

3. Student Enrolment and Permissions

Teachers are solely responsible for ensuring that they have any permissions, authority, approvals, or consents required to invite, enrol, or manage students on the platform.

Incapsulate does not independently verify:

• Teacher authority.
• School authority.
• Parent or guardian consent.
• Educational permissions.

Teachers acknowledge that they are responsible for obtaining any permissions required by their school, institution, parent body, governing body, or applicable law.

4. Classroom Management

Teachers may create and manage classrooms using the functionality provided by the platform.

Teachers are responsible for:

• Maintaining classroom membership.
• Managing student joins and removals.
• Managing assignments and assessments.
• Managing assignment availability and deadlines.
• Monitoring the use of class codes.
• Ensuring classroom information remains accurate.

Incapsulate does not supervise classroom administration.

5. Assignments, Assessments and Educational Content

Teachers may create, distribute, assign, or manage assignments, assessments, and other educational activities through the platform.

Teachers remain solely responsible for:

• Educational decisions.
• Assignment and assessment content created by them.
• Question wording, answers and marking schemes.
• Assessment settings.
• Marks awarded to students.
• Feedback provided to students.
• Uploaded files, images and educational resources.
• Compliance with school or institutional requirements.

Incapsulate provides tools to facilitate educational activities but does not participate in educational decision-making.

Teachers retain responsibility for verifying the accuracy of any automatically calculated marks, generated content or platform output before relying on it for educational purposes.

6. Student Information

Teachers may have access to information relating to students assigned to their classrooms.

Teachers agree to:

• Access student information only for legitimate educational purposes.
• Maintain appropriate confidentiality.
• Not disclose student information unnecessarily.
• Handle student information responsibly.
• Use student work only for legitimate educational purposes.

Teachers must comply with applicable privacy and data protection obligations.

7. Teacher Seat Subscriptions

Teacher subscriptions are billed based on the number of student seats purchased.

Current pricing is published on the platform and may be updated from time to time.

Teacher subscriptions may be paid through PayFast recurring billing or approved school invoice and EFT arrangements where offered by Incapsulate.

Eligible Teacher PayFast subscriptions may include a 3-day free trial. Unless cancelled before the end of the trial period, recurring billing will begin automatically after the trial in accordance with the applicable subscription terms.

Teachers acknowledge that:

• Student access may depend on the teacher maintaining an active subscription.
• Failed payments may result in suspension of teacher functionality.
• Failed payments may result in the removal of Teacher Seat access provided to students.
• Student access may be affected if the teacher subscription is cancelled or suspended.
• Seat increases and decreases may take effect immediately or from the next billing cycle depending on the applicable billing rules.

8. Prohibited Conduct

Teachers may not:

• Share teacher account credentials.
• Share subscriptions between unrelated organizations.
• Sell, transfer, sublicense, or redistribute access to the platform.
• Circumvent seat limits.
• Use the platform for unlawful purposes.
• Upload malicious software or harmful content.
• Attempt unauthorized access to platform systems.
• Share class codes publicly.
• Use student seats for persons who are not genuine students under their management.
• Upload unlawful or infringing educational material.
• Use the platform to store unrelated files.
• Use Incapsulate or uploaded educational material to train artificial intelligence systems without written permission from Incapsulate.
• Share copyrighted material without the necessary rights or permissions.

Incapsulate may suspend or terminate access where such conduct occurs.

9. No Employment or Accreditation Relationship

Access to teacher functionality does not create:

• An employment relationship.
• A partnership.
• An agency relationship.
• A certification.
• An accreditation.
• A professional endorsement.

Incapsulate does not certify, verify, accredit, supervise, or endorse teachers using the platform.

10. Limitation of Responsibility

Teachers remain responsible for:

• Educational decisions.
• Student management.
• Assignment and assessment content.
• Marks and feedback issued to students.
• Uploaded educational material.
• Obtaining required permissions.
• Compliance with school policies.

Incapsulate provides educational software tools and does not assume responsibility for teaching activities conducted by teachers.

11. Changes to this Agreement

Incapsulate may update this Teacher Agreement from time to time.

The latest version will always be made available through the platform and may be accessed from the user's profile or legal information section.

Where required by applicable law, teachers will be notified of material changes or asked to accept updated terms before those changes take effect.
