Student & Parent Consent

1. Introduction

This Student and Parent Consent applies to students using the Incapsulate platform and, where applicable, their parent or legal guardian.

This document forms part of the Incapsulate Terms and Conditions and Privacy Policy.

By creating an account, using the platform, or allowing a student to use the platform, the student and parent or guardian acknowledge and agree to this consent.

2. Educational Platform

Incapsulate is an educational software platform that provides:

• Interactive simulations.
• Educational resources and visual learning tools.
• Assignments and assessments.
• Student submissions.
• Teacher marking and feedback.
• Progress tracking.
• Classroom management functionality.
• CAPS-aligned Grade 10–12 Physical Sciences content.

Incapsulate is intended to support learning and teaching.

Incapsulate does not replace formal classroom instruction, professional teaching services, curriculum requirements, educational advice, or examination preparation.

3. Parent or Guardian Consent

Where a student is under the age of 18, the student and/or the person creating the account represents that the student's parent or legal guardian has reviewed and consented to the student's use of the platform.

The parent or guardian remains responsible for ensuring that any required permissions have been provided.

Incapsulate may request additional consent verification where reasonably necessary.

4. Collection of Information

Students and parents acknowledge that Incapsulate may collect and process information necessary to provide educational services, including:

• Name and surname.
• Email address.
• Telephone number.
• Parent or guardian contact information where applicable.
• Date of birth or age information.
• School name.
• Grade level.
• Classroom membership.
• Assignment and assessment activity.
• Student submissions.
• Uploaded files, images and attachments.
• Assessment results and marks.
• Teacher feedback.
• Educational progress information.
• Subscription and access information.

Uploaded files and educational records may be stored by Incapsulate and its service providers for as long as reasonably necessary to provide the platform, preserve educational records, comply with legal obligations, or complete account-deletion processes.

5. Teacher Relationships

Students may be linked to teachers through classroom functionality.

Where a student joins a classroom, the teacher may be able to view information relating to:

• Assignment and assessment submissions.
• Assessment results and marks.
• Teacher feedback.
• Educational progress.
• Classroom participation.
• Files or attachments submitted through the classroom.

Teachers may create assignments and assessments, set availability periods, review submissions, award marks and provide feedback through the platform.

Students and parents acknowledge that teacher decisions relating to assignments, marks and feedback are the responsibility of the relevant teacher or school.

Incapsulate does not independently verify teacher authority and relies on users to ensure that appropriate permissions have been obtained.

6. Student Responsibilities

Students agree to:

• Use the platform responsibly.
• Keep login credentials secure.
• Not share accounts or passwords.
• Respect teachers and other users.
• Use the platform for legitimate educational purposes.
• Complete their own work unless collaboration is specifically permitted by their teacher.
• Submit only lawful and appropriate files or content.
• Not upload material that infringes another person's intellectual property or privacy rights.

Students may not engage in conduct that violates the Incapsulate Terms and Conditions or Acceptable Use Policy.

7. Subscription Access

Students may access the platform through:

• Free Student Access to selected learning content without payment details or a paid subscription.
• Teacher-provided access through a teacher subscription.
• Individual Monthly Student Subscriptions.
• Individual Yearly Student Subscriptions.

Free Student Access is not a time-limited subscription trial and does not automatically convert into a paid subscription.

Individual Student Subscriptions provide access to paid premium content and begin after successful payment.

Where a student with an individual subscription joins a teacher classroom, the individual subscription may be paused while teacher-provided access is active.

If teacher-provided access later ends, the student's paused individual subscription may automatically reactivate in accordance with the Incapsulate Terms and Conditions.

Students and parents may receive service-related emails concerning access changes, assignments, billing, security, account administration and once-off requests for feedback.

Students and parents acknowledge that access to subscription or teacher-provided features may depend upon the continued validity of the applicable subscription or Teacher Seat.

8. Uploaded Content and Educational Records

Students may upload answers, images, documents or other attachments where the platform allows this.

Students and parents confirm that uploaded material must be lawful, appropriate and relevant to the educational activity.

Teachers may review, mark and provide feedback on submitted work.

Account deletion may remove access to the account and schedule certain uploaded files for deletion. Some educational, billing or administrative records may be retained where reasonably required by law, accounting obligations, dispute resolution or the integrity of classroom and assessment records.

9. Educational Outcomes

Incapsulate provides educational tools and resources but does not guarantee:

• Academic performance.
• Examination results.
• Subject mastery.
• Admission outcomes.
• Educational achievement.

Learning outcomes depend on many factors outside the control of Incapsulate.

10. Changes to this Consent

Incapsulate may update this Student and Parent Consent from time to time.

The latest version will always be made available through the platform and may be accessed from the user's profile or legal information section.

Where required by applicable law, students, parents, or guardians will be notified of material changes or asked to provide any additional consent required before those changes take effect.
