Acceptable Use Policy

1. Introduction

This Acceptable Use Policy applies to all users of the Incapsulate platform, including students, teachers, parents, guardians, administrators, and any other users who access platform services.

This policy forms part of the Incapsulate Terms and Conditions.

By accessing or using the platform, users agree to comply with this Acceptable Use Policy.

2. Purpose of the Platform

Incapsulate is intended for legitimate educational use.

Users may access the platform for learning, teaching, classroom management, assignments, assessments, submissions, marking, feedback, progress tracking, educational support, and related educational activities.

Users must use the platform responsibly and in accordance with applicable laws and platform policies.

3. Account Security

Users must:

• Maintain the confidentiality of account credentials.
• Use only their own account.
• Promptly notify Incapsulate of suspected unauthorized access.
• Take reasonable steps to protect their account information.

Users may not:

• Share accounts or passwords.
• Access another user's account without authorization.
• Attempt to bypass authentication systems.
• Allow another person to use their account.
• Use another person's session, access token, class code, or credentials.
• Attempt to evade account, device, or session restrictions.

4. Educational Integrity

Students are expected to complete their own work unless collaboration has been specifically permitted by their teacher.

Users may not:

• Misrepresent academic work.
• Submit work completed by another person as their own.
• Falsify assignment or assessment submissions.
• Manipulate marks, answers, assessment results, or progress records.
• Impersonate another user.
• Misrepresent educational progress.
• Use automated tools, artificial intelligence, or unauthorised assistance where prohibited by the relevant teacher or school.
• Share assessment questions, answers, marking information, or restricted assignment content without permission.

Teachers remain responsible for establishing and communicating the academic integrity rules that apply to their classrooms and assessments.

5. Respectful Conduct

Users must treat other users respectfully.

Users may not:

• Harass, threaten, intimidate, or abuse others.
• Upload offensive, unlawful, discriminatory, or harmful content.
• Engage in conduct that disrupts educational activities.
• Use the platform to bully or target other users.
• Upload sexually explicit or exploitative material.
• Upload content that violates another person's privacy.
• Publish another user's personal information without authority.
• Use reviews, feedback, submissions, or uploaded content to threaten or defame another person.

Incapsulate may remove content or suspend access where such conduct occurs.

6. Classroom and Teacher-Provided Access

Teacher-provided student access is intended only for genuine students managed through the applicable teacher's classrooms.

Users may not:

• Share class codes publicly.
• Circumvent seat limits.
• Provide platform access to unauthorized users.
• Use student seats for persons who are not genuine students under the teacher's management.
• Attempt to manipulate subscription or seat allocation systems.
• Join a classroom without the teacher's permission.
• Continue using a class code after being instructed not to do so.
• Transfer teacher-provided access to another person.
• Create false or duplicate accounts to obtain additional access.

Incapsulate may suspend or remove access where misuse is detected.

7. Uploaded Files and User Content

Users may upload files, images, answers, profile pictures, educational resources, submissions, or other content only where the platform permits it.

Users must ensure that uploaded content:

• Is lawful and relevant to the intended educational purpose.
• Does not contain malware, harmful code, or deceptive files.
• Does not infringe copyright, privacy, confidentiality, or other rights.
• Does not contain inappropriate, abusive, or prohibited material.
• Does not disclose unnecessary personal information.

Users remain responsible for content they upload. Incapsulate may remove, restrict, quarantine, or delete uploaded content where reasonably necessary for security, legal compliance, platform operation, or enforcement of this policy.

8. Intellectual Property and Content Protection

All platform content remains the intellectual property of Incapsulate unless otherwise stated.

Users may not:

• Copy platform content for redistribution.
• Reproduce, copy, distribute, or create derivative works from any simulations, calculators, assessments, assignments, videos, graphics, or other educational content without Incapsulate's explicit written authorization.
• Resell platform content.
• Publish substantial portions of platform content on other websites or platforms.
• Remove copyright notices or ownership markings.
• Copy or distribute teacher-created content without permission.
• Extract question banks, answer data, marking rules, or assessment structures.
• Use screenshots or recordings to reproduce substantial platform content.
• Remove branding, watermarks, attribution, or access restrictions.

A limited, revocable, non-transferable licence is granted solely for authorised educational use in accordance with the platform's Terms and Conditions.

9. Software Protection

Users may not:

• Reverse engineer platform software.
• Attempt to discover source code.
• Circumvent security measures.
• Probe, scan, or test platform vulnerabilities without authorization.
• Attempt unauthorized access to databases, servers, or infrastructure.
• Interfere with platform operation.
• Exploit or attempt to exploit platform bugs or vulnerabilities.
• Alter requests, identifiers, permissions, or API calls to gain unauthorised access.
• Interfere with billing, refund, classroom, assignment, or marking systems.

Any such activity may result in immediate suspension or termination of access.

Incapsulate reserves the right to pursue legal remedies, seek damages, recover costs, and report unlawful activity to the appropriate authorities where permitted by applicable law.

10. Artificial Intelligence and Automated Access

Users may not:

• Use automated tools to extract platform content.
• Scrape educational content or user information.
• Download platform content in bulk without permission.
• Use bots or scripts to access or interact with the platform.
• Use Incapsulate content, question data, marking information, uploaded educational resources, or platform outputs to train artificial intelligence systems, machine-learning models, or similar technologies without written permission from Incapsulate.
• Use automated tools to manipulate submissions, marks, reviews, billing, classroom membership, or account activity.

Incapsulate reserves the right to block or restrict automated access.

11. Malware and Security Threats

Users may not:

• Upload malicious software.
• Upload viruses, worms, ransomware, or harmful code.
• Attempt denial-of-service attacks.
• Interfere with platform security.
• Distribute harmful files through the platform.

Such conduct may result in immediate suspension and referral to appropriate authorities where applicable.

12. Monitoring and Enforcement

Incapsulate may investigate suspected violations of this policy.

Where reasonably necessary, Incapsulate may:

• Restrict access.
• Suspend accounts.
• Remove content.
• Reject or remove uploaded files.
• Disable class codes.
• Remove students from classrooms.
• Disable classrooms.
• Terminate subscriptions.
• Preserve relevant records where reasonably required for investigation, security, dispute resolution, or legal compliance.
• Recover losses or damages arising from policy violations where permitted by law.
• Report unlawful conduct to relevant authorities.
• Pursue legal remedies available under applicable law.

Incapsulate is not obligated to monitor all user activity but reserves the right to take action where violations are identified.

13. Changes to this Policy

Incapsulate may update this Acceptable Use Policy from time to time.

The latest version will always be made available through the platform and may be accessed from the user's profile or legal information section.

Where required by applicable law, users will be notified of material changes or asked to accept updated terms before those changes take effect.
